INTRODUCTION
These Terms of Service ("Terms") govern the access and use of services provided by Singularitya S.A., registered under CNPJ No. 51.685.487/0001-24 ("Singularitya", "we", "our", or "us"), made available through personalized conversational artificial intelligence agents and advanced digital solutions, operating primarily through the WhatsApp Business platform and other digital communication channels.
By using our services, you declare that you have read, understood, and agree to these Terms. If you do not agree with any provision herein, we request that you do not use our services.

PURPOSE AND NATURE OF SERVICES
These Terms establish the conditions for using the solutions provided by Singularitya, which include:
- Personalized conversational artificial intelligence agents: Advanced communication solutions that go beyond simple automations, offering contextualized and adaptive conversational experiences;
- Intelligent conversational interfaces for WhatsApp: Systems that transform WhatsApp into a powerful productivity tool with integrated AI capabilities;
- AI-enhanced service solutions: Platforms that combine intelligent automation with contextual understanding capabilities;
- Contextual memory and personalization systems: Technologies that allow maintaining context and personalizing interactions over time, creating more natural and efficient experiences.
When using our services, the user commits to:
- Use the services in a lawful, ethical manner and in compliance with applicable legislation;
- Not use communication channels to disseminate illegal, discriminatory, offensive, defamatory content or content that violates third-party rights;
- Not perform actions that may compromise the security, stability, or integrity of Singularitya's systems and algorithms;
- Provide truthful, accurate, and updated information when requested;
- Respect usage limits defined by Meta/WhatsApp, as well as applicable Brazilian and international legislation;
- Not attempt reverse engineering, decompilation, or extraction of artificial intelligence models or proprietary algorithms.

IDENTIFICATION AND EXPERIENCE PERSONALIZATION
When interacting with our AI agents, you will be identified by your name, phone number, and other data provided during conversations. Singularitya may maintain this conversational history and contextual data to:
- Offer continuity and personalization of interactions;
- Allow the AI agent to understand the historical context of requests;
- Improve the quality and accuracy of responses provided;
- Develop system improvements based on usage patterns.
All processing of this data will be conducted in accordance with our Privacy Policy.

INTELLECTUAL PROPERTY AND USAGE LIMITATIONS
All content, interface, language models, algorithms, conversational flows, business logic, and technological elements used in AI agents and other Singularitya solutions are its exclusive property or properly licensed, and are protected by Brazilian and international intellectual property laws.
The use of services does not grant the user any intellectual property rights over:
- Artificial intelligence models;
- Algorithms and machine learning systems;
- Conversation flows and response logic;
- Natural language processing methodologies;
- Any content generated by the systems.
Reproduction, copying, modification, distribution, or commercialization without express authorization from Singularitya is expressly prohibited.

LIMITATION OF LIABILITY
Singularitya employs significant efforts to offer high-quality services, but is not responsible for:
- Service interruptions caused by failures in third-party platforms (such as the WhatsApp platform);
- Decisions made by the user based on information or suggestions provided by AI agents;
- Incorrect or incomplete information provided by users that may affect the quality of responses;
- Indirect, incidental, or consequential losses or damages related to the use of solutions;
- Access failures resulting from problems in the user's network or internet providers;
- Technological limitations inherent to artificial intelligence systems, including possible inaccuracies or incorrect interpretations.

PRIVACY AND PERSONAL DATA PROCESSING
The processing of personal data collected during the use of our services is regulated by Singularitya's Privacy Policy, accessible at: [insert Privacy Policy URL].
We highlight that our AI agents:
- Process data to offer personalized experiences;
- Retain contextual information to maintain conversation naturalness;
- May use aggregated and anonymized data for algorithm improvement;

TERMINATION AND ACCESS SUSPENSION

Singularitya reserves the right, at its sole discretion, to suspend, restrict, or terminate access for any user who:
- Violates these Terms of Service;
- Uses services for illicit or fraudulent purposes;
- Attempts to compromise system security or integrity;

- Causes intentional overload on servers or infrastructure.
Singularitya may change these Terms at any time, with prior notification through its official channels or directly via conversational agents. Changes will take effect immediately after publication.

- Independence of Clauses: If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.
- Non-Waiver: Failure by Singularitya to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

JURISDICTION AND APPLICABLE LEGISLATION
These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes arising from the interpretation or execution of these Terms will be resolved in the jurisdiction of Belo Horizonte/MG, with express waiver of any other, however privileged it may be.
